Las semejanzas entre el Derecho y la Literatura han sido señaladas desde hace un buen tiempo; sin embargo, la aproximación académica frente a estas relaciones es algo más bien novedoso. Este intento formal por delinear los cruces entre Derecho y Literatura pueden agruparse en dos corrientes principales: la “escuela edifi cante” y la “escuela científi ca”. Mientras que la primera procura estudiar los textos literarios con el propósito de extraer posibles criterios de justicia que puedan ser aplicados al Derecho, la (...) segunda intenta aplicar categorías y métodos interpretativos propios de textos literarios a los distintos textos normativos. Acaso las dos posturas tienen un objetivo loable: de una u otra manera ambas buscan renovar, para bien, la práctica jurídica. Por desgracia, la novedad y frescura de estas ideas han desembocado en una aceptación acaso ingenua de varios de sus postulados que bien podría repercutir en una pérdida de rigor al estudiar y analizar tanto textos literarios como textos normativos. Some proponents of global justice question that opening borders is an effective strategy to alleviate global poverty and reduce inequalities between countries. This article goes a step further and asks whether an open borders policy is compatible with the objectives of global distributive justice. The latter, it will be argued, entails the ordering of needs, the assignment of priorities and the preference or subordination of some interests over others. In other words, global justice requires the establishment of conditions and restrictions (...) on mobility. On the contrary, open borders claim an unrestricted and unconditional (not unqualified) freedom of movement, limited only by public health considerations, serious threats to national security or democratic institutions, but not by an aspiration for maximizing global redistributive utility. The main point is that not only would freedom of movement be instrumentalized, losing its presumptive moral force, but ultimately open borders as a remedy of global justice are an oxymoron. Este artículo reflexiona sobre la idea de una ética del débil que muestra su desconfianza frente al auge del individualismo capitalista exacerbado que alimenta un perfeccionismo tecnológico. La modernidad ampliada, como proyecto inacabado, sirve de contexto para mostrar la fuerte disociación entre humanidad y naturaleza. Ambos conceptos puestos en relación con el perfeccionismo de los seres humanos acaban por devaluar e incluso negar una naturaleza humana más o menos permanente. Por ello, apremia retomar un concepto de naturaleza humana entendido como (...) aquel programa de perfeccionamiento de un ser libre, que incluya una serie de elementos comunes debido a rasgos genotípicos y fenotípicos, a la vez que un concepto ontológico de dignidad humana que parta de la igualdad política de todos los seres humanos. El tiempo histórico debe repensarse para que las decisiones éticas, médicas, jurídicas en el ámbito tecnológico se tomen con prudencia y responsabilidad, teniendo en cuenta que lamentablemente los procesos llevados a cabo son irreversibles. Models represent their target systems in one way or another. But what does it mean for a model to represent something beyond itself? This paper details different aspects of this problem and argues that the semantic view of theories does not provide us with an adequate response to any of these.

There is a broad consensus on the legitimacy of states to control immigration. However, this belief has recently been questioned, among other reasons, due to the contradiction with current practices in emigration and internal mobility. The principle of symmetry states that any restriction on immigration should also apply to emigration; or that, to the contrary, if there is a right to emigrate, there should be a corresponding right to immigrate. The principle of coherence posits that every reason one might have (...) for moving within a country also counts for moving between countries. This article proposes to extend the coherence principle from external to internal migration, arguing that the same reasons that justify restrictions on mobility across borders justify restrictions on mobility within borders too. Therefore, either freedom of movement is a fundamental right or the right of the political community to control mobility prevails. The interests at stake are in both cases the same, so asymmetry is not warranted. This leads us to an apagogical argument for open borders. (shrink)

Drawing on the Agency-Stewardship approach, which suggests that manager profile may range from the agent model to the steward model, this article aims to examine how important CEOs are to corporate social responsibility (CSR). Specifically, this exploratory study proposes the existence of a relationship between manager profile and CSR practices and that this relation is mediated by the perceived role of ethics and social responsibility. After applying a mediated regression analysis using survey information collected from 149 CEOs in Spain, results (...) show that those closer to the steward model are more inclined to attach great importance to ethics and social responsibility, and to implement CSR practices in their companies. Results also provide support for the suggested mediating effect. Thus, this article extends research in understanding top managers as drivers for CSR and suggests new ways to deal with this issue empirically. (shrink)

Mais especificamente, tratarei o que vejo como problemas emsua apresentação da virtude como uma forma de conhecimento, e sua proposta – corporificada natese da unidade das virtudes – de que as virtudes comumente reconhecidas deveriam ser vistascomo manifestações parciais da virtude enquanto tal. Também enfocarei a assertiva de McDowellde que (...) o conhecimento que constitui a virtude não pode ser visto como tendo um conteúdoproposicional que se preste a uma codificação em princípios de conduta – a tese de nãocodificabilidade– e a relação da postura pessoal de McDowell com a empreitada mais ampla daética de virtudes. La presencia de nuevos movimientos religiosos cristianos, también conocidos como sectas, aunque este término incluye un matiz peyorativo, es cada vez más evidente en Corea del Sur. En la actualidad hay alrededor de dieciocho grupos operativos, entre los que destacan cinco: la Federación de Familias para la Paz y la Unificación Mundial, más conocida como la Iglesia de la Unificación; la Iglesia Shincheonji de Jesús: el Templo del Tabernáculo del Testimonio; La Iglesia de Dios Sociedad Misionera Mundial; la Misión Cristiana (...) del Evangelio, más conocida como Jesus Morning Star (JMS); y Guwonpa, también llamada Good News Mission. Este trabajo indagará el origen de los primeros nuevos movimientos religiosos cristianos, emergidos en el norte de la península durante la ocupación japonesa, así como su expansión por el sur con el fin de la guerra de Corea. Por último, se centrará en el grupo cristiano más influyente del país a nivel nacional e internacional: la Iglesia de la Unificación. (shrink)

Este trabajo es continuador de la línea de investigación sobre la filosofía del derecho alemana contemporánea llevada a cabo por el autor, a través del análisis de cuestiones clásicas de la filosofía del derecho. Para ello, se aborda la concepción de la pena de muerte en el pensamiento jurídico-filosófico de Arthur Kaufmann, el cual abordó esta problemática en relación con el contenido esencial del derecho a la vida y el debate doctrinal de posguerra. El artículo está dividido en las siguientes (...) partes: en primer lugar, se analiza, desde un punto de vista jurídico-filosófico, la evolución histórica de la pena de muerte a la centrando la atención en los fundamentos para su abolición y las posiciones a favor de su mantenimiento. En segundo lugar, se establecen similitudes y diferencias, en el entendimiento de la pena capital, entre la teología moral contemporánea, el pensamiento de Aquino y la obra de Arthur Kaufmann. A continuación, en base a una visión comparativa, se expone cómo el autor alemán, a la vez que mantiene una concepción católica ante la pena de muerte y la culpa sin pena, sigue la senda dejada por su maestro Radbruch, siendo en este tema no necesariamente incoherente. El presente trabajo propone tres principios de justicia en la política migratoria. En primer lugar, el principio de asistencia plantea que los Estados ricos tienen la obligación primaria de asistir a las personas pobres en sus países de origen, y solo una obligación secundaria de acoger a aquellas que no puedan ser asistidas donde viven. En segundo lugar, el principio de contención sostiene que el empleo de la coacción debe ser proporcional al fin perseguido, de manera que solo en situaciones (...) de riesgo inminente, directo y grave estarían justificadas las restricciones a la inmigración. Por último, el principio de restitución requiere que, cuando sea necesario restringir la inmigración, dicha restricción sea parcial y temporal; los Estados deben procurar vías de tránsito alternativas y restablecer la libertad de circulación lo antes posible. Además, el artículo considera algunas objeciones a los principios propuestos y concluye con una defensa de la gobernanza internacional de las migraciones. (shrink)

Uma exegese filosófica da problemática do niilismo na obra de Cioran, partindo de uma análise lexicográfica dos usos discursivos deste conceito, mas sem se limitar a ele (que está longe de ter um estatuto privilegiado no discurso cioraniano). Levando em conta a reviravolta que marca uma cisão no âmago da obra de Cioran, na transição entre seus escritos romenos e franceses, e combinando à lexicografia um procedimento propriamente hermenêutico do tema do niilismo, conclui-se com uma reflexão sobre o nexo entre (...) niilismo e humor na obra francesa de Cioran, notadamente em Silogismos da amargura (1952), em contraste com o niilismo da “seriedade infinita” (sinônimo de desespero) que caracteriza a sua obra romena. The present article aims to reconstruct some political consequences of aristippean philosophy in the light of fragment fs, 570 (= ssr, iv.a.163 = Memorabilia, ii.1.1–17) in order to show how Aristippus’ agreement with Socrates’ remarks fits the Cyrus composed by Xenophon in his Cyropaedia. In pursuance of this, I will review Aristippus’ ethics and will show how, despite the opposition with his hedonistic principles for a pleasureable life, Aristippus accepts that a good ruler needs to be a enkratic one—althouth he (...) argues that pursuing any rule is senselessness. After showing how it is possible to recognice some hedonistic position in Adeimantus’ question at the beginning of Republic, iv, I will present the enkratic character of Cyrus. Finally, I will conclude pointing out the political continuities between Aristippus’ acceptance in fs, 570 and the ideal of ruler constructed by Xenophon. (shrink)

In a seminal work, Tversky and Kahneman showed that in some contexts people tend to believe that a conjunction of events (e.g., Linda is a bank teller and is active in the feminist movement) is more likely to occur than one of the conjuncts (e.g., Linda is a bank teller). This belief violates the conjunction rule in probability theory. Tversky and Kahneman called this phenomenon the “conjunction fallacy”. Since the discovery of the phenomenon in 1983, researchers in psychology and philosophy (...) have engaged in important controversies around the conjunction fallacy. The goal of this paper is to explore the most important of these controversies, namely, the controversy about the nature of the conjunction fallacy. Is the conjunction fallacy mainly due to a misunderstanding of the problem by participants (misunderstanding hypothesis) or is it mainly due to a genuine reasoning bias (reasoning bias hypothesis)? A substantial portion of research on the topic has been directed to test the misunderstanding hypothesis. I review this literature and argue that a stronger case can be made against the misunderstanding hypothesis. Thus, I indirectly provide support for the reasoning bias hypothesis. (shrink)

I argue that Derrida’s reading of Heidegger in _Geschlecht III_ needs to be situated within the philosophico-political context of Derrida’s 1984–85 seminar—given under the general title _Philosophical Nationality and Nationalism_—from which _Geschlecht III_ is extracted. In the first part of the paper, I reconstruct (...) Derrida’s general problematic of national-humanism as he lays it out in the opening sessions of the seminar, before arriving at his reading of Heidegger, who will be part of “a sequence of German national-philosophism,” as Derrida calls it. In the second part, the paper turns explicitly to _Geschlecht III_ where, as I show, Derrida’s thoroughgoing denunciation of a national-humanism in Heidegger becomes all the more telling when seen through the theoretical matrix of the seminar. Dentre os problemas que têm norteado nossas investigações, duas indagações ganham destaque. Como a informação e o conhecimento estão inseridos no arcabouço teórico de Karl Marx? Que janelas o pensamento de Marx nos abre para discutir do papel da informação e do conhecimento no universo do trabalho, na atualidade? Fazendo dessa perspectiva objeto de pesquisa, busca-se apreender a inserção da informação e do conhecimento no arcabouço teórico marxiano, tendo como referências principais O Capital, Teorias da mais-valia e Capítulo VI Inédito. A exposição aborda alguns construtos categoriais da obra marxiana onde a informação e o conhecimento laboral são elementos centrais, a exemplo das categorias mercadoria, força de trabalho, trabalho simples e trabalho complexo, subsunção formal e subsunção real, trabalhador coletivo, trabalho produtivo e trabalhador produtivo. Após a discussão das ideias de Marx, são apresentados alguns aspectos do trabalho na atualidade, para os quais o complexo categorial marxiano revela-se pertinente e necessário. Labour, information and knowledge: rereading marx in the information age AbstractAmong the problems that have guided our investigations, two questions are crucial. How information and knowledge take part in the theoretical framework conceived by Karl Marx? Which windows does Marx's thought open to discuss the role of information and knowledge in the current labour realm? Adopting this perspective, we aim to apprehend the insertion of information and knowledge in the Marxian theoretical framework, especially in the books Capital, Theories of Surplus-Value and Chapter VI (unpublished). The exposition presents some Marxian categorical constructs where information and labour knowledge are central elements, such as the categories commodity, labour force, simple unskilled labour and complex skilled labour, formal subsumption and real subsumption, collective labour, productive labour and productive worker. After discussing the ideas of Marx, we present some aspects of the contemporary labour, where the Marxian categorical complex is pertinent and necessary. (shrink)

Women oppression is a universal reality. She is a victim, the exploited, the dominated and the other. As a postcolonial thinker, I argue that Filipino women have been victims of the movement of social dialectics. As Philippine society evolved and developed, she had been a victim not only of male domination but also of political economy. This research shows how female subordination and male domination emerged in the Philippines. As such, it contends that there is a blurring identity of Filipino (...) women -that is, Filipino women as situated in the neocolonial period - are victims of political economy and male domination. This paper tracks Derrida’s allusion to the “phoenix motif” in the recently published Life Death seminar, showing how it foreshadows and overlaps with the political problematic of “national humanism” made explicit in Geschlecht III. I argue that, be it in Hegel, Fichte, Nietzsche, or Heidegger, biological life is always in the service of a spiritual life that finds its breath in a certain reappropriation of the German idiom. Following Derrida, I argue that this “philosophy-of-life German” (cet allemand philosophe de la (...) vie) introduces a sinister equivocality between these thinkers and National Socialism, and this in spite of all their prudence to shield their discourses from such a co-option. This article attempts to read the very concept of reading as articulated and problematized by Derrida’s newly discovered Geschlecht III. I argue that Derrida enacts a reading of Heidegger in Geschlecht III in ways that help us understand the strong sense Derrida gives this word. In the article’s first part, I dwell on Derrida’s—and Heidegger’s—(quasi)methodological precautions that problematize the traditional concept of reading so as to open the way for a reading of Heidegger that does not bank on the metaphysical (...) presuppositions the very same Heidegger warns us against time and again. In the second part, I turn to Derrida’s topotypological examples that show us what traditional methodology problematically presupposes when “reading” Heidegger. The article ends by turning to the Derridean notion of “overprinting”—and the uncanny effects of doubling it implies—as a way to think about what it means to read and countersign Heidegger’s text. This paper elaborates on the link between different types and degrees of experience that can be gone through within a form of life or collectivity—the so-called levels of immersion—and the development of distinct types of tacit knowledge and expertise. The framework is then probed empirically and theoretically. In the first case, its ‘predictions’ are compared with the accounts of novices who have gone through different ‘learning opportunities’ during a pre-operational training programme for running a huge nickel industrial plant in Brazil. These are also analysed vis-à-vis the experience of an expert who has designed and experienced the outcomes of two pre-operational training sessions in the nickel industry before developing and managing the one discussed here. Theoretically, the framework is used to pinpoint exactly what interactional experts who have developed their expertise through linguistic socialisation alone are able to do as well as to analyse the case of technical connoisseurs. The results indicate that the proposed framework is useful. It supports the design and improvement of training programmes for the development of tacit knowledge while at the same time bringing about a refined analysis of claims concerning the abilities of types of experts and expertise. How can we identify and estimate workers’ tacit knowledge? How can we design a personnel mix aimed at improving and speeding up its transfer and development? How is it possible to implement tacit knowledge sustainable projects in remote areas? In order to answer these questions, it is necessary to distinguish between types of tacit knowledge, to establish what they allow for and to consider their sources. It is also essential to find a way of managing the tacit knowledge ‘stock’ and (...) distribution within the workforce. In short, a conceptual framework is needed to manage tacit knowledge. Based on previous works and 2 years of action research, this paper introduces such a framework and describes its partial application to support the pre-operational training and hiring in a large industrial plant in Brazil. Two contributions emerge from the research. First, the concept of ‘levels of similarity’ is introduced as a means to qualify the experience of workers and estimate the associated tacit knowledge. Second, the capability of carrying out three types of judgement properly and speedily is put forward as being a core ability of those who possess what has been called ‘collective tacit knowledge’ (Collins in Organ Stud 28(2):257–262, 2007). In practical terms, the results indicate the opportunity for companies to capitalize on the experience and tacit knowledge of their workers in a systematic way and with due recognition. Ultimately, positive impacts are expected in their absorptive capacity as well as in their management and human resources systems, accident prevention, productivity and the development of sustainable projects in remote areas. This paper based on the distinction between the instrumental and normative views of stakeholder management explores how business education and personal moral philosophies may influence the orientation adopted by an individual. A mediated regression analysis using survey information collected from 206 Spanish university students showed that those exposed to management theories were less willing to consider stakeholders when making business decisions if the consequent economic impacts on the firm were omitted. The results also provided support for a negative effect of (...) business education on idealism and a mediating effect of the latter on the relationship between education and stakeholder management orientation. This study thus raises awareness on the influence of business education on individuals’ ethical decision-making processes and suggests some possible changes for business education. (shrink)

Our goal in this paper is to reassess the relationship between norms and life by drawing on the philosophy of Georges Canguilhem, particularly some of his unpublished lectures about teratology and sexual determination. First, we discuss the difficulties Canguilhem identified in the introduction of life and sexuality as objects of philosophical reflection. Second, we reassess Canguilhem’s understanding of normativity as rooted in life and the axiological activity of the living. Third, we analyze how Canguilhem drew from past and contemporary teratology (...) to conceive of the notions of anomaly and abnormality. Finally, we reconstruct Canguilhem’s analysis of a case of hermaphroditism, highlighting how he presented it as evidence that sexual determination is the result of a normative choice. One of the key contributions of the paper to scholarly literature on Canguilhem is a better understanding of his notion of choice, which was considered not the conscious and intentional act of a subject but rather an axiological activity of the living. We conclude by positioning Canguilhem’s concept of normativity and his belief that norms are produced by the living in relation to the naturalist/normativist divide in medicine. (shrink)

Meu objetivo aqui é o de abordar os escritos iniciais de Wittgenstein com base na tradição do misticismo filosófico. O benefício de minha leitura se deve ao fato de permitir uma certa clarificação no que tange a determinadas passagens obscuras, além de trazer à tona perspectivas inexploradas concernentes ao período inicial do autor; fase esta que, em minha opinião, ainda requer um nível de escrutínio adicional.Entendo que especialmente no caso do Tractatus, Wittgenstein não incida no místico por conta de uma (...) limitação da perquirição lógico-linguística relacionada a determinadas regiões do conhecimento, pelo contrário. Irei sugerir que a aplicação da lógica ocorre com o propósito de estabelecer o escopo do místico. Portanto, o que proporei em seguida é a tentativa de desenvolvimento de uma “interpretação mística” emrelação aos escritos iniciais do autor.AbstractMy goal here is to approach Wittgenstein’s initial writings based on the tradition of philosophical mysticism. The benefit of my reading is that it will allow some clarification in regard to obscure passages and still unexplored perspectives concerning this initial period which, in my opinion, still require additional scrutiny. As I see it, especially when it comes to the Tractatus, Wittgenstein does not “arrive” at the mystical due to the failure of a logical-linguistic inquiry/analysis related to certain realms of knowledge, on the contrary. I will make a case for supposing that the application of logic occurs with the purpose of establishing the scope of the mystical. Therefore, what I propose here is an attempt to develop a “mystical interpretation” of the initial writings of the author. (shrink)

I propose a reading of some theoretical-critical texts published during the first decade of the twenty-first century, in order to perform a cartography of the complex weft of aesthetic knowledge and, in doing so, to consider new inflections and points of view to read the arts, the literature and its policies. The inquiries of Jacques Rancière, Andreas Huyssen, Nicolás Bourriaud, Reinaldo Laddaga and Néstor García Canclini are projected on the contemporary scene as reformulations of a discourse that tries to refer (...) the work with form and sensation, now disseminated as a production that reorganizes the material an symbolic conditions of art in its dialogue with the world. Each of these authors make unique characterization of contemporary aesthetics, all of which question the modern disciplinary rigidity to identify aesthetic practices as acts that can reorganize the sense of community and the ways of life through sensible exploration. Our aim is to cast light on socioeconomic residential segregation effects on life satisfaction. In order to test our hypothesis, we use survey data from Chile for the years 2011 and 2013. We use the Duncan Index to measure segregation based on income at the municipality level for 324 municipalities. LS is obtained from the CASEN survey, which considers a question about self-reported well-being. Segregation’s impact upon LS is not clear at first glance. On one hand, there is evidence telling (...) that segregation’s consequences are negative due to the spatial concentration of poverty and all the woes related to it. On the other hand, segregation would have positive effects because people may feel stress, unhappiness, and alienation when comparing themselves to better-off households. Additionally, there is previous evidence regarding the fact that people prefer to neighbor people of a similar socioeconomic background. Hence, an empirical test is needed. In order to implement it, we should deal with two problems, first, the survey limited statistical significance at the municipal level, hence we use the small area estimation methodology to improve the estimations’ statistic properties, and second, the double causality between segregation and LS; to deal with the latter, we include lagged LS as a regressor. Our findings indicate that socioeconomic segregation has a positive effect on LS. This result is robust to different econometric specifications. (shrink)

Dans sa thèse de médecine de 1943 sur le normal et le pathologique, Georges Canguilhem se sert largement des idées de Kurt Goldstein lorsqu’il définit la normalité comme la capacité de l’organisme à créer de nouvelles normes de vie dans un débat polarisé avec son milieu. Pourtant, il déclara ensuite que les conceptions de Goldstein avaient constitué pour lui un « encouragement et non une inspiration ». Les archives personnelles de Canguilhem nous permettent effectivement de considérer le rapport de Canguilhem (...) à Goldstein comme une convergence plutôt que comme une influence mais surtout, l’usage que Canguilhem fait de Goldstein nous permet de mieux saisir la portée de ses propres idées. Nous interrogeons dans une première partie la conception holiste de l’organisme de Goldstein, dans ses rapports à la gestalt-théorie et à Kant, conception qui se réfère au processus d’actualisation de l’essence de l’organisme dans son rapport avec le milieu. Ceci nous permet d’appréhender l’usage que fait Canguilhem de certains concepts et idées de Goldstein pour élaborer son propre concept de normativité vitale. Dans une deuxième partie, nous nous proposons de comprendre la manière dont Canguilhem pose le problème du rapport de la connaissance à la normativité vitale à partir de sa lecture des textes du neurologue allemand.
